This terms and conditions regulate the use of the website http://www.authenticspain.es/ (the website hereafter), brand from the Agency Donosti Receptivo SL (the agency hereafter) offers to the internet users.
Any user purchasing products/services from this website declares being over 18 years old.
The user is responsible for treating confidentially and adequately the passwords that may be provided by the agency to access certain parts of the website, avoiding the use of those by anyone not authorised.
The user accepts being responsible of any economic consequence deriving from the use of the website, with or without passwords, by the user or a third person.
The user declares that all the information provided, when such is required by the website, will be complete and precise and will be updated in case of any changes occurred.
PURCHASING PRODUCTS/SERVICES THROUGH THE WEBSITE
The user, through the website from the agency, has access to information about products and services from other providers in the tourism sector and is able to book holidays and purchase some of these products.
The sale of packages and other touristic services will be done by the agency, whose legal details are in the bottom of this document.
The booking and purchase of products and services is subject to the terms and conditions from each specific provider established for each case. The user consents accepting and respecting those terms and conditions established by the providers and/or organisers of those products/services, including, with expository and no limitative character, the payment of any amount yielded and fulfilling any rules and restrictions regarding the availability of tariffs, products or services.
The preparation and update of the information about the offers, products or services, prices, routes, distances, features and any data or information relevant about them offered through the website and that has the offer stamp from the provider, corresponds to the respective provider and/or organisers from those packages, without the agency being responsible of the maintenance, revision, supervision or updates and being unable to verify the veracity, update, accuracy or if the information is complete.
The providers, within their obligations, will be held responsible towards the user for the fulfilment of those obligations derived from the legislation and the sale terms and conditions of each one of the products and holidays booked, without the “agency” assuming any responsibility towards the products or services it does not provide directly.
In the case that the agency provided any discounts (excluding supplements and taxes), these will be refundable once the booking has been done (to the account provided by the user), but always having been booked directly through the website.
PRIVACY
The personal and private information received by the agency may be integrated in an automatic database, authorising the treatment of such for sending commercial offers and advertising by any means (correspondence, telephone, fax, mailing, or any other system) from the agency or third parties used by the agency but always with the limitations from the Ley Orgánica 15/1999 13th December on Data protection and any other applicable law.
The user is hereby informed of his right to access, rectify, cancel and oppose, regarding his personal data according to the Law, being able to exercise his rights contacting directly the agency.

The agency declines any responsibility for no-purchase from the user of a “cancellation insurance”.
If by force majeure there would be deficiencies in the bookings, confirmations and/or execution of any holiday or service booked through the website, for circumstances not foreseeable by the agency, or if it was impossible to fulfil one or more of the services contracted, the client renounces to present any kind of demand or claim against the agency, regarding those deficiencies or unfulfilments, unless he/she could demonstrate the lack of professional diligence from the agency.
APPLICABLE LAW
These terms and conditions, as well as any relationship between the user and the agency will be ruled according to Spanish Law. The unfulfilment of all or any of these terms and conditions will mean the resolution of the contractual relationship. Both parts renounce their own applicable law and agree to subject exclusively to the Courts of San Sebastian.

Internet. Su utilización supone para el usuario la aceptación plena de las condiciones generales comprometiéndose a actuar de conformidad con la ley.
El Usuario que contrate servicios a través de la presente web declara que es mayor de edad (es decir, tiene, al menos, 18 años).
El Usuario se hace responsable de tratar de forma confidencial y adecuada las contraseñas que le pudieran ser asignadas por "la agencia" para acceder a determinados espacios de la Web, evitando

algunos de estos productos.
La venta de viajes combinados y demás servicios turísticos a través de la Web se llevará a cabo por "la agencia", cuyos datos legales figuran a pie del presente documento.
La reserva o compra de productos y servicios queda sujeta a los términos y condiciones específicos que los proveedores y/u organizadores de dichos viajes combinados establezcan para cada caso. El
Usuario consiente en aceptar y respetar los términos y condiciones de compra que establezcan los proveedores y/u organizadores de dichos productos y/u servicios, incluyendo, con carácter
enunciativo y no limitativo, el pago de cualesquiera importes devengados y el cumplimiento de cualesquiera normas y restricciones acerca de la disponibilidad de tarifas, productos o
servicios.
La elaboración y actualización de la información sobre ofertas, productos o servicios, precios, rutas, distancias, características y cualesquiera otros datos e informaciones relevantes acerca de
los mismos ofrecidos a través de la Web y que tengan en el cartel de la oferta el sello del proveedor, corresponde a los respectivos proveedores y/u organizadores de los viajes combinados, sin
que "la agencia" sea responsable del mantenimiento, revisión, supervisión o actualización ni tenga posibilidad de verificar la veracidad, actualización, precisión o lo completo de dicha
información.
Los proveedores, dentro del ámbito de sus obligaciones, serán responsables frente al Usuario del cumplimiento de las obligaciones derivadas de la normativa en vigor y de los términos y
condiciones de venta de cada uno de los productos y viajes combinados que se contraten, sin que "la agencia" asuma obligación ni responsabilidad alguna respecto de aquellos productos o servicios
que no preste directamente.
En el caso que la agencia aplique descuentos (excluyendo suplementos, tasas e impuestos), éstos serán reembolsables una vez efectuada la reserva (a la cuenta que el usuario facilite), siempre que
la reserva se efectúe directamente en la web.
PRIVACIDAD
La información de carácter personal recibida por la agencia puede incorporarse un fichero automatizado de datos de carácter personal, autorizándose el tratamiento de la misma para el envío de
ofertas comerciales y publicidad por cualquier medio (correspondencia, teléfono, fax, mailing o cualquier otro medio telemático) propio o de terceros por la agencia y con las limitaciones de la
Ley Orgánica 15/1999 de 13 de Diciembre sobre Protección de Datos de Carácter Personal y demás legislación aplicable.

La agencia declina toda responsabilidad por la no contratación por parte del usuario del seguro de cancelación/anulación.
Si por causas de fuerza mayor se derivaran deficiencias en las reservas, confirmaciones y/o ejecución de cualquier viaje o servicio contratado desde la web, por circunstancias no previsibles o no
solucionables por la agencia, o si fuera imposible el cumplimiento de alguna de las prestaciones pactadas, el cliente renuncia a presentar cualquier tipo de reclamación contra la agencia, por
esas deficiencias o incumplimientos, a menos que quede demostrada la falta de diligencia profesional de la agencia.
LEGISLACIÓN Y JURISDICCIÓN APLICABLE
Las presentes Condiciones Generales, así como cualquier relación entre el Usuario y la agencia se regirán por la legislación española. El incumplimiento de todas o alguna de las presentes
condiciones, dará lugar a la resolución de la relación contractual. Ambas partes, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, se someten a la jurisdicción y
competencia exclusiva de los Juzgados y Tribunales de San Sebastián.
